This all depends on how many previous convictions a person has. In addition, Michigan has instituted sentencing guidelines which have different categories that a probation officer uses to determine the recommended sentence for felony offenses. As far as misdemeanors go, the district judge usually follows the recommendation of the probation officer who does the pre-sentence interview.

However, whenever there are extenuating circumstances or unique factss, having an attorney willing to take the time to discuss the situation with the judge prior to sentencing can impact the ultimate outcome.
